Borrower insurance: what the law says

Loan insurance weighs on the cost of credit. You have rights to choose it and change it.

Updated 23 October 2026

Compulsory or not?

No law makes insurance compulsory for a mortgage, but lenders require it in practice. You may choose your insurer provided the cover is equivalent to what the lender asks.

Changing insurance during the loan

Under the Lemoine law you can cancel and change borrower insurance at any time, free of charge, provided the new contract gives equivalent cover. In some cases the health questionnaire is no longer required.

Aggravated health risk

The AERAS convention eases access to insurance and credit for people with aggravated risk.

Frequently asked questions

Can the lender impose its insurance?
